End User License Agreement (EULA)

Introduction

This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User," "you," or "your") and FIYA ("Company," "we," "our," or "us") for the use of the FIYA mobile application ("App").

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THIS AGREEMENT, DO NOT DOWNLOAD, INSTALL, OR USE THE APP.

1. License Grant

Subject to your compliance with the terms and conditions of this Agreement, FIYA grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Download and install the App on your personal mobile device(s)
  • Access and use the App solely for your personal, non-commercial purposes
  • Access content and features through a valid subscription (where applicable)

Restrictions: This license does NOT grant you any right to:

  • Use the App for any commercial purposes
  • Resell, redistribute, or sublicense the App
  • Use the App on behalf of any third party
  • Transfer or share your license with others

2. License Restrictions

You expressly agree that you will NOT:

  • Copy, Modify, or Distribute: Copy, reproduce, modify, adapt, translate, create derivative works from, or distribute the App or any part thereof
  • Reverse Engineer: Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Remove Notices: Remove, alter, or obscure any proprietary notices, labels, or marks on or in the App
  • Develop Competing Products: Use the App to develop, create, or support any product or service that competes with the App
  • Sublicense: Rent, lease, lend, sell, sublicense, or transfer the App to any third party
  • Illegal Use: Use the App for any illegal, harmful, fraudulent, or unauthorized purpose
  • Circumvent Controls: Bypass, circumvent, or attempt to bypass any access controls, security measures, or digital rights management systems
  • Automated Access: Use any automated system (including robots, bots, spiders, scrapers) to access the App

3. Ownership and Intellectual Property

Ownership

The App and all copies, modifications, and derivative works thereof are and shall remain the exclusive property of FIYA and its licensors.

Intellectual Property Protection

The App is protected by:

  • Copyright laws and international copyright treaties
  • Trademark laws
  • Trade secret laws
  • Other applicable intellectual property laws and treaties

4. Subscription and In-App Purchases

Subscription Terms

The App offers various subscription plans to access premium features:

  • Available Plans: Monthly, Quarterly, Annual subscriptions
  • Platform Processing: All subscriptions are processed through Apple App Store or Google Play Store
  • Payment: Charges will be applied to your App Store or Play Store account at confirmation of purchase
  • Auto-Renewal: Your subscription automatically renews unless you cancel at least 24 hours before the end of the current subscription period

Managing Subscriptions

You can manage and cancel your subscriptions through your device settings:

  • iOS Users: Settings > [Your Name] > Subscriptions
  • Android Users: Google Play Store > Menu > Subscriptions

Refunds

All refund requests are subject to the refund policies of Apple App Store or Google Play Store. FIYA does not directly process refunds for subscriptions.

5. Third-Party Components and Services

The App may include or incorporate third-party software components, libraries, or frameworks. The App integrates with third-party services including:

  • Firebase (Google) for authentication and notifications
  • Mixpanel for analytics
  • Apple/Google for payment processing

6. User Content and Conduct

Your Responsibilities

You are solely responsible for:

  • All content you upload, post, or share through the App
  • Your conduct and interactions with other users
  • Ensuring your content complies with applicable laws and does not infringe third-party rights

Prohibited Content

You may not upload or share content that is illegal, offensive, defamatory, obscene, or infringes intellectual property rights.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIYA EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

Health and Fitness Disclaimer

IMPORTANT: The App provides fitness information and workout programs for general informational and educational purposes only. THE APP DOES NOT PROVIDE MEDICAL ADVICE AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

  • Consult a Physician: Always seek the advice of your physician before beginning any exercise program
  • Not Medical Advice: Information provided through the App should not be relied upon for medical diagnosis or treatment
  • Assumption of Risk: Physical exercise involves inherent risks of injury. You acknowledge and accept all risks associated with using the App

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FIYA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  1. The amount you paid to FIYA in the twelve (12) months preceding the event, OR
  2. One hundred U.S. dollars ($100.00)

9. Indemnification

You agree to indemnify, defend, and hold harmless FIYA from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising from:

  • Your use or misuse of the App
  • Your violation of any term or condition of this Agreement
  • Your violation of any applicable laws or third-party rights
  • Any content you upload, post, or share through the App

10. Termination

Termination by You

You may terminate this Agreement at any time by deleting the App from all your devices and ceasing to use the App.

Termination by FIYA

Your rights under this Agreement will terminate automatically and immediately without notice if you fail to comply with any term or condition of this Agreement.

Effect of Termination

Upon termination:

  • Your license to use the App immediately terminates
  • You must immediately cease all use of the App and delete all copies
  • No refunds will be provided for any prepaid subscription fees except as required by law

11. Governing Law and Dispute Resolution

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Jurisdiction and Venue

Any dispute arising out of or relating to this Agreement shall be resolved exclusively in the courts of Dubai, United Arab Emirates.
